Terms of Service
These terms describe TalkGraph as it operates at present. Your content remains yours, plans provide what is stated when you buy them, recording must be lawful, and AI output must be checked. Every registered user will receive email and in-app notice before these terms change.
1. Who we are
At present, TalkGraph is operated by Talkgraph LTD, a company registered in England and Wales (company number 17377289) with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. "TalkGraph", "we" and "us" mean that company. You can reach us at hello@talkgraph.ai.
2. The service at present
At present, TalkGraph turns live speech, typed text and imported recordings or documents into structured knowledge maps, connects maps into a personal knowledge index called your Brain, and provides related export, sharing and AI-assisted features. The service is in early access and its functions may evolve. Your ability to export your own content will remain available while the service operates. Every registered user will receive advance notice of any change to these terms under section 19.
3. Your account
At present, the public demo can be tried without an account. An account is required to save graphs, build your Brain and use the full service. You must be at least 13 and legally able to accept these terms. Keep access to your email and sign-in provider secure, provide accurate information and tell us promptly if you believe your account has been compromised. You are responsible for activity you authorise through your account.
4. Business and enterprise use
If you use TalkGraph on behalf of a business or other organisation, you confirm at present that you have authority to bind it to these terms. The organisation is responsible for its authorised users and for deciding what information they enter into TalkGraph. Talkgraph LTD remains the data controller for the TalkGraph service as described in the current Privacy Policy.
5. Your content and generated work
At present, TalkGraph does not claim ownership of your speech, transcripts, imported material, maps, edits, generated artifacts or Brain. You retain the rights you already hold in material you provide. You must have the rights, permission or other lawful basis needed to provide content that belongs to or identifies another person. You grant TalkGraph a non-exclusive, worldwide, royalty-free licence to process, store, reproduce, transmit, modify and display content only as needed to provide, secure and support the service and to show it to people you explicitly share it with. The licence ends when the content is deleted, subject to the backup cycle and legal retention described in the Privacy Policy. We do not at present train AI models on your content or use it for advertising.
6. TalkGraph's service and intellectual property
The TalkGraph software, interface, brand, designs, documentation and underlying technology, excluding your content, belong at present to Talkgraph LTD or its licensors. Your subscription gives you a limited, non-exclusive, non-transferable right to use the service under these terms; it does not transfer ownership of the software. You may not copy, decompile, reverse engineer or remove rights notices except where applicable law expressly permits it.
7. Recording and mapping other people
At present, TalkGraph can capture and map conversations. You are responsible for complying with the law and obtaining any notice or consent required from participants. Do not record people secretly where their knowledge or consent is required. Participant names and words may be personal data, and a share link can expose them to anyone who receives it. The in-app notice helps communicate capture but does not transfer your responsibility to TalkGraph.
8. Acceptable use
At present, you must not use TalkGraph to break the law, infringe another person's privacy or intellectual-property rights, upload malicious code, harass or exploit people, gain unauthorised access, interfere with security controls, probe or overload the service, share credentials improperly, scrape or automate access outside published features, resell the service, or build a competing dataset from it. Security research requires prior written permission. We may investigate and restrict activity that places the service, another person or their data at risk.
9. AI output
At present, maps, cards, summaries, questions and answers may be generated by AI from user-provided material. Output can be wrong, incomplete, duplicated or misattributed and may not be unique. It is an aid to thinking rather than medical, legal, financial or other professional advice. Check consequential information before relying on it. Your edits take precedence inside your own map.
10. Plans, nodes and billing
At present, free and paid plans are metered in nodes. Current inclusions and prices appear on the Pricing page. Stripe processes payments; card details do not reach TalkGraph's servers. Subscriptions renew automatically until cancelled and remain active until the end of the paid period. Unused nodes do not roll over unless the plan expressly says they do. Prices shown to UK and EU consumers include VAT; other taxes are added where legally required. Existing subscribers receive at least 14 days' email notice before a price change applies to their next renewal.
11. Cancellation, refunds and chargebacks
At present, you may cancel a subscription or delete your account at any time. UK consumers have a 14-day cooling-off right on an initial subscription. By asking us to begin immediately, you acknowledge that a proportionate charge may apply for service already supplied during that period. Top-ups are delivered immediately; a refunded or charged-back top-up removes the corresponding nodes, and any refund may be reduced proportionately where nodes have been used. Your statutory rights remain unaffected.
12. Fair use and service limits
At present, plan limits, rate limits and safeguards protect availability and provider capacity. We may temporarily throttle or restrict unusually intensive automated use, fraud, scraping, attacks or activity that imposes disproportionate technical cost. Where practicable, we will explain the restriction and allow you to resolve it. Severe abuse or an immediate security risk may be restricted without advance notice.
13. Sharing and third-party services
At present, graphs stay private until you create a share link. You control and are responsible for what you share, who receives a link and whether participant information should be removed first. Rotating or disabling a link prevents future access through the previous address but cannot retrieve copies already downloaded. Google sign-in, Stripe checkout and other linked or user-directed third-party services apply their own terms to the parts they operate.
14. Copyright and rights complaints
At present, if you believe material available through TalkGraph infringes your copyright, privacy or another legal right, email hello@talkgraph.ai with your identity, the affected material or share link, the right involved and why you believe it is infringed. We may temporarily restrict the material while investigating, request further evidence, notify the account holder and remove access where appropriate. Knowingly false notices may cause loss and liability.
15. Availability, changes and discontinuation
At present, TalkGraph is an early-access service supplied on an "as available" basis. We work to keep it reliable but cannot promise uninterrupted operation or compatibility with every device. Maintenance, internet failures and outages at hosting, transcription, AI or payment providers may affect it. If TalkGraph is discontinued, registered users will receive reasonable notice and time to export content, except where law or an immediate security event prevents this.
16. Suspension and ending the agreement
At present, you may end this agreement by deleting your account. We may suspend or end access for a serious or repeated breach, non-payment, fraud, legal requirement, immediate security risk or discontinuation of the service. We give notice and an opportunity to correct the issue where practicable. Content ownership, licences already exercised, payment obligations, liability, intellectual property and governing-law provisions survive where their nature requires it.
17. Liability and warranty
Nothing excludes liability that law does not allow us to exclude, including liability for death or personal injury caused by negligence or for fraud. Subject to that, the service is provided at present without warranties beyond those required by law. We are not liable for indirect or consequential loss, loss of profit, or loss caused by an event outside our reasonable control. Our total liability arising from the service is limited to the greater of £50 and the amount you paid TalkGraph in the 12 months before the event giving rise to the claim. Consumer statutory rights remain unaffected.
18. Assignment and standard terms
At present, you may not transfer this agreement without our written consent. TalkGraph may transfer it as part of a financing, reorganisation or sale of the business, and will notify registered users. These terms, the Privacy Policy and any plan terms shown at purchase form the agreement between us. If a provision is unenforceable, the remainder continues and the affected provision applies as far as the law allows. A delay in enforcing a right is not a waiver of it.
19. Changes and notice to every user
These terms describe TalkGraph as it operates at present. Before any change takes effect, we will publish the new dated version and notify every registered user by email and in the application. We aim to give at least 14 days' notice, except where a shorter period is required by law or needed to address an urgent security issue. The notice will explain the change and effective date. Changes do not apply retroactively. Continuing to use TalkGraph after the effective date means you accept the revised terms; you may stop using the service and delete your account before then.
20. Governing law
At present, these terms and any non-contractual obligations arising from them are governed by the law of England and Wales, whose courts have jurisdiction. A consumer living elsewhere retains any mandatory protections and court rights provided by the law that applies to them.
