Terms of Service

These are the terms between you and TalkGraph. They are written to be read: short sections, plain language, no surprises. The one-line version - your content is yours, pay only for what the plan says, do not record people unlawfully, and AI output is an aid, not gospel.

1. Who we are

TalkGraph is operated by Talkgraph LTD, a company registered in England and Wales (company number 17377289) with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. "TalkGraph", "we" and "us" mean that company. You can reach us at hello@talkgraph.ai.

2. The service

TalkGraph turns live speech and imported recordings or documents into structured knowledge maps, and connects those maps into a personal knowledge index we call your Brain. The service is currently in early access: features may change, be added or be withdrawn as the product develops. We will not remove your ability to export your own content.

3. Your account

You can try TalkGraph's demo without an account. An account is required to save graphs, build your Brain and use the full service. You must be at least 13 years old. You are responsible for keeping access to your email account secure, since signing in happens through it, and for everything done under your account. Give us accurate information and keep it up to date.

4. Your content

Everything you put into TalkGraph - your speech, transcripts, imported files, maps, edits and your Brain - belongs to you. You grant us the limited licence we need to operate the service: to process, store, transmit and display that content to you and to anyone you explicitly share it with. We do not use your content to train AI models, and we do not sell it or share it for advertising. If you delete content, the licence ends for that content.

5. Recording other people

TalkGraph captures conversations. You are responsible for complying with the laws that apply where you are, including obtaining any consent required from other people you record or map. Do not use TalkGraph to record people secretly where the law requires their knowledge or consent. The in-app capture notice exists to help you with this; it does not transfer the responsibility to us.

6. Acceptable use

Do not use TalkGraph to break the law, to infringe others' rights, to attempt to gain unauthorised access to our systems or other people's data, to probe or overload the service, to resell it, or to build a competing dataset by scraping it. We may suspend accounts that put the service or other users at risk.

7. AI output

Maps, cards, summaries and answers are generated by AI from what was said. They can be wrong, incomplete or misattributed. They are an aid to your thinking, not professional advice - check anything that matters before relying on it. You control your cards and can correct them; your edits take precedence over the AI.

8. Plans, nodes and billing

Free and paid plans are metered in nodes (the cards you map). Paid subscriptions are billed through Stripe, our payment processor - your card details never touch our servers. Subscriptions renew automatically until cancelled; you can cancel at any time and your plan runs to the end of the paid period. If we change prices, existing subscribers get notice by email at least 14 days before their next renewal. Unused nodes do not roll over unless the plan says otherwise. Prices displayed to consumers in the UK and EU include VAT. All other prices are exclusive of taxes; where we are required by law to collect taxes on your purchase, they will be added to your invoice at the applicable rate.

9. Cancellation and refunds

You can stop using TalkGraph and delete your account at any time. If you are a consumer in the UK, you have a 14-day cooling-off right when you first subscribe; by subscribing you ask us to start the service immediately, so if you cancel within those 14 days we may deduct a proportionate amount for the service already provided. Top-ups deliver their nodes instantly: if a top-up payment is later refunded or charged back, the nodes it bought are removed from your account at the same time, and where some of those nodes have already been used, the refund may be reduced in proportion to what was used. Nothing in these terms affects your statutory rights.

10. Availability and changes

We aim to keep TalkGraph available and fast, but it is an alpha service provided "as is": we do not guarantee uninterrupted availability, and maintenance or third-party outages (hosting, transcription, AI providers) can cause downtime. We may change or discontinue features. If we ever discontinue the service entirely, we will give you reasonable notice and time to export your content.

11. Ending the agreement

You can end it at any time by deleting your account. We can suspend or end your access if you seriously or repeatedly break these terms, if we are required to by law, or if the service is discontinued - with notice where practicable. Sections that by their nature should survive (your ownership of your content, liability, governing law) survive termination.

12. Liability

Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or fraud. Subject to that, we are not liable for indirect or consequential losses, loss of profit, or loss of data caused by events outside our reasonable control, and our total liability arising out of the service is limited to the greater of £50 and the amount you paid us in the 12 months before the claim arose.

13. Changes to these terms

We may update these terms as the product and the law evolve. If a change materially affects your rights, we will notify you by email or in the app before it takes effect. Continuing to use TalkGraph after a change takes effect means you accept it; if you do not, stop using the service and delete your account.

14. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction - though if you are a consumer living elsewhere in the UK, you keep the protection of your local law and courts.
